This was not a two party consented recording which is illegal in Massachusetts. Akin to the illegal recording made of his call to Karen Read.
Under Massachusetts General Laws, Chapter 272, Section 99, you can only record the call if both parties explicitly consent.
That means the other person must clearly agree after being told it’s being recorded.
Silence or continuing to talk is not considered consent under Massachusetts law — courts have said consent must be actual, not implied. Aidan Kearney has broken the law here.
