my response to youtube comments calling me a "shill" for Ukraine because of the combat footage analysis I do. I'm not a nihilistic observer of the war. I'm not sitting on the fence pretending I'm so enlightened and unbiased. I've always said I support Ukraine in so far as it aligns with American interests. I am sympathetic to their struggle. I'd rather someone be HONEST and say where they stand. If you support Russia that's fine, at least we can now have a discussion about it from there. I don't think everyone or even most people who supports Russia are a "shill", shill is the most overused brain rot word to write people off with different beliefs than you instead of engaging with them. Shill means someone who takes money to change their beliefs or who's beliefs are for sale. Believe it or not, people can look at the same conflict and same set of facts and actually can legit come to different conclusions based on their own research, their own personal values and their own beliefs. When it comes to the fact that I often choose combat footage to analyze where Ukraine wins the battle, that's because they have the most footage avaliable that is high quality and from multiple perspectives of the same fight, GOPRO, overhead drones, etc. That has the most value for looking at the tactics and strategies. Anyone with two eyes can see obviously the Ukrainian military is taking heavy losses and losing territory the past two years. Yes I'm more drawn to those battles where they win. These aren't news reports they're a look at single battles.

Some of you have tagged me for my take on this video today. A VERY general analysis is a follows, but I'm thinking a jury *probably* does not see this video: Prior vandalism of a police car/scuffle is referred to as “other bad acts” evidence, which is not admissible to prove conformity therewith. (FRE 404(b)). The “other bad acts” rule exists to prevent juries from convicting based on a person’s past misdeeds ("man, this guy is a real piece of shit, he probably deserved it") rather than on the specific facts of the incident actually on trial. CBP would argue it should be shown to prove motive/intent, i.e., to show the decedent’s hostility toward police. The decedent would say that the shooting encounter at issue is fully captured on video, so the jury can assess demeanor, resistance, and threat level directly, making prior conduct minimally probative (at best) but overwhelmingly prejudicial. I think the decedent wins this. The separation of several days, the different nature of the conduct, and the risk that the jury will reason “he hates cops, therefore he must have been aggressive and deserved what happened”, in addition with the shooting video speaking for itself probably means this would not be admitted. I wouldn't bet my house on it or anything, but that's my quick take. I'd love to hear what other litigators think.

There are a number of exceptions. Biggest one is "opening the door." I get on the stand to defend myself and introduce witnesses to narrate about my calm, peaceful demeanor. At that point, my related prior bad acts will almost certainly get in because I opened the door. In some sex assault cases, prior acts are admitted because of the nature of the crime. In Louisiana, even if a civilian defendant did not know of the victim’s violent history at the time of the incident, that history can be admissible if there is also evidence that the victim committed a hostile act in the immediate incident itself. This goes purely to who the aggressor was. Not sure but I think entrapment ("I was being entrapped by the sexy undercover agent, I don't visit HOOKERS!" "Uh James you were arrested for hookin 3 times last month."

And game players are fed up with crap. They’re fed up with crap being universally praised by the industry because it pushes the right politics. And they’re tired of being told to sit down, shut up, or frack off.
