BREAKING NEWS: Former @NPA_Prosecutes boss, Advocate Shamila Batohi, the one who staged a walk out of the #NkabindeInquiry which she had personally asked for, has officially “decided not to continue giving evidence” and this hearing.

@Mathaba2022 Sec 38 states, An AO must take effective and appropriate steps to prevent irregular expenditure, not “must prevent it.” Appropriate steps in this case is having a procurement process in place that has appropriate committees that are put in place to prevent irregular expenditure.

Mentioning being a CFO as if will help your argument. Section 38 of the PFMA is clear: an accounting officer must prevent irregular expenditure and act on any financial misconduct. In this case, the National Commissioner was informed of irregularities before the tender was awarded and failed to stop it. Even after the award, further warnings were raised, yet he still did not act. That is a direct failure to fulfil his duties under Section 38 which is exactly why the charges against him are justified.

The closing of cross examination by SC Chaskalson is surely laying the ground for dismissal and possibly fraud and corruption charges against Gareth. Whichever way it goes, things will never be the same for this guy… #MadlangaCommission

This decision does not make any sense. Putting the national commissioner on the dock with Vusi Matlala comes across as an attempt to sully his name and remove him from the role through guilt by association. He had no role in awarding this tender and he did not benefit from it.

Gareth doesn’t seem to understand that there’s apparent and perceived conflict of interest. And for a CFO not to understand that is problematic. There’s a reason why bidders are requested to complete this in bid documents, and why members ought to declare prior to any meeting.

This is the MDB 4 form of all bids at City of Tswane. A bidder should be disqualified if they did not declare. Furthermore, anyone sitting on the BEC or BAC that has not declared their interests in the bidders renders the bid irregular. #MadlangaCommission

If we are all being objective, we know that Mnisi’s reference to “this guy” he’s managing cannot be who he refers as Mbungulu. Why doesn’t he say “I am managing Mbungulu. This guy will never win”. He’s demonstrated his English vocab and comprehension.

@Sinawo_Thambo It’s not his desperation but rather the alleged “connected” persons who have used the name of the EFF in their conversations. We all are interested in how the EFF are connected in this tender rigging. It’s why we are having this commission.

We opposed Adv Matthew Chaskalson’s appointment as a consultant at the NPA in 2024, vocally so, because it risked jeopardising the standing of the prosecutorial process. We did this not in opposition of him, but in defence of the integrity of the process, because he would be assisting on the prosecution of evidence at one forum, after leading evidence at another (Zondo Commission) His desperation to find the EFF in the Madlanga Commission when several witnesses deny it, is now suspect. ewn.co.za/2024/09/24/sin…

@Sunflowerreal All tenders have a contact person for technical queries and SCM for bid related queries. He can’t give unilateral advice on open bids where he’ll be adjudicating. As for “we” and “ours” being a way of communicating and meaning something else is just an insult

Gareth Mnisi you are way too arrogant and rude and when you reply to Adv Matthew Chaskalson SC in a condescending tone .To start with you can never give advice to anyone regarding a tender process or anything that relates to City of Tshwane .A CFO giving advice to🤣🤣🤣 a company that is bidding for a tender worse he says he will adjudicate.
