Nashville Mayor Freddie O’Connell wants his constituents to believe that higher property taxes are due solely to rising property values. Does he expect us to forget last year’s 26% property tax increase? Or the 34% increase that the Metro Council—of which he was a member at the time—imposed in 2020? Not going to happen. In a victory for the rule of law and the separation of powers, the Supreme Court struck down the Trump Administration’s tariffs imposed under the International Emergency Economic Powers Act of 1977. As the Chief Justice recognized, the Framers were clear in Article I, Section 8 of the Constitution: the power to impose taxes—including tariffs—belongs to Congress. This ruling properly restores the separation of powers and ensures that this and future administrations cannot use vague emergency statutes to enact sweeping economic policy. How did Nashville Electric Service (NES) respond to the crisis caused by the winter storm last month? Not with a mea culpa. Rather, NES is circling the wagons by hiring at least two high-profile lobbying firms to represent it at the state legislature to fend off reforms to its operations or structure. We’ve long called for reform to the practice of taxpayer-funded lobbying, whereby local government entities spend millions of dollars hiring private lobbyists to represent them at the state capitol in Nashville.
