Smaller biotech firms with innovative approaches can't afford the regulatory gauntlet, so we get fewer competing treatments and less diverse research. Meanwhile, the agency's stamp of approval creates a moral hazard; companies know FDA clearance shields them from liability, reducing their incentives for thorough safety testing. Every day the FDA delays a beneficial drug, real people suffer and die waiting for treatments that free markets would deliver faster and cheaper. The agency doesn't create pharmaceutical innovation; it rations access to the innovation that entrepreneurs create despite bureaucratic obstruction.
