🚨NEW on @CBSNews.com: The gunman who carried out the mass shooting last weekend in Austin, Texas, assaulted a woman three months earlier at a Tesla facility, according to a lawsuit filed Thursday in Texas. (reporting with @JasonAllenLive / MarkHooper) The suit claims Ndiaga Diagne, who shot and killed three people and wounded more than a dozen others while wearing a shirt with Iranian regime insignia on it, "violently and without provocation" attacked a 65-year-old Tesla employee in December, the lawsuit said. The woman, Lilian Brady, never knew the identity of the man who attacked her until she recognized his face when she saw news of the shooting this week, her lawyer, Robert Hilliard, told CBS News. FBI investigators interviewed Brady this week, the lawyer, Robert Hilliard said. The FBI did not immediately respond to a request for comment. Diagne was shot and killed by police after he fired into a crowd on an Austin bar patio at around a.m. Sunday, March 1. Travis Co. DA office formally told Austin Police today it has concluded a review, and will take no action against the officers who killed the shooter. Attorney for the officers had expressed some uncertainty about how it would play out, even after DA's statement calling them heroes.

I talked to a friend of Jorge Munoz-Pederson today who was with him Sat night/Sun morning. He had just moved to Austin from Minnesota, two weeks ago.

Police in Austin have identified the two people killed in the mass shooting Sunday as Savitha Shan and Ryder Harrington. The chief also said a third person may be removed from life support today The shooter was not previously on the radars of police, or FBI.

CBS News has obtained a photo showing Ndiaga Diagne, the gunman in the deadly Austin shooting, after he was killed by police.   It shows the clothing he was wearing during the attack, including a shirt with a  design similar to the Iranian flag.
