The Misapplication of "Schedule 1".
The claim that "fraud and forgery" (such as carrying a fraudulent ID) falls under "Schedule 1" and therefore justifies a private arrest.
While it is true that certain types of forgery and fraud are listed in Schedule 1 of the Criminal Procedure Act, this does not create a right for private citizens to stop people on the street and demand their identity or immigration documents.

Section 42 of the Criminal Procedure Act (Act 51 of 1977)—often mistakenly referred to in the post as "Act 59".
This section does NOT grant private citizens the authority to conduct general "immigration checks" or demand identity documents from others.
Private Arrest Limitations: Section 42 allows a private person to arrest someone only under specific, narrow circumstances:
If the person commits or attempts to commit an offence in their presence.
If the person is reasonably suspected of having committed an offence listed in Schedule 1 of the Act (which includes serious crimes like murder, rape, robbery, etc.).
No Authority to Demand ID: There is no provision in the Criminal Procedure Act that empowers a private citizen to stop individuals, demand their proof of citizenship, or check their immigration status.
Attempting to do so, or detaining someone based on a suspicion that they are an "illegal foreigner" (which is an administrative matter, not necessarily a criminal offence justifying private arrest under these sections), can expose the person performing the "check" to serious criminal charges, including:

We have received the Interdict Papers from President Ramaphosa’s lawyers seeking to interdict the work of the impeachment committee. Our lawyers are studying the court papers, and we will comment after.
