@SethAStern @jfeldis @FreedomofPress They were evidence of association and aligned motivation with others, supporting elements of the conspiracy and material assistance to terrorists charges.

This verdict is appalling — esp. the conviction of Daniel Sanchez-Estrada merely for transporting constitutionally protected zines, similar to the pamphlets that prompted the press freedom clause. The implications extend far beyond so-called "Antifa." theguardian.com/us-news/2026/m…

@SethAStern @jfeldis @FreedomofPress The zines were part of the evidence that his wife and others were guilty of the conspiracy and assistance to terrorists crimes that they were convicted of. Duh.

@jfeldis @FreedomofPress What was the evidence he was convicted of concealing? Zines. What crime did the zines contain evidence of? The First Amendment's protection doesn't depend on what label prosecutors use, it depends on the substance of the charges.

Daniel Sanchez-Estrada was convicted of concealing evidence (as stated in the linked guardian article) which is not protected speech. He was not convicted based on the content of the materials By making such a false claim shows that @FreedomofPress is corrupt or partisan and should not be considered a legitimate defender of free speech

@VISAINAMERICA @FreedomofPress I don't think those have a stated mission of combatting "views, or opinions" that "are inimical to the interests of this state and the United States of America" and those states were not considering legislation to fight "ideologies inconsistent with American principles."

Next time, take a look at this and try to provide a good-faith distinction as to why the Florida-proposed unit will be different. It will be interesting to read. - New York State Police operates a Counter Terrorism Unit tied to the New York State Intelligence Center (NYSIC), emphasizing threat detection and prevention through multi-agency fusion. - California Highway Patrol has a Counterterrorism and Threat Awareness Section with Regional Threat Assessment Centers coordinating with FBI Joint Terrorism Task Forces. - New Jersey's Office of Counter-Terrorism (under the Attorney General) coordinates statewide law enforcement efforts and liaises with federal partners.

Florida wants its own CIA. That could lead to unchecked domestic surveillance A bill to create a state intelligence operation would allow scrutiny based on "opinions" — and could prompt other states to follow FPF's Seth Stern and Lauren Harper explain: theguardian.com/commentisfree/…

Incarcerated people have long faced discipline for reading literature that guards don't like. Now Daniel Sanchez Estrada is facing federal trial tomorrow for possessing anarchist zines. Jeremy has more in @theintercept theintercept.com/2026/02/16/dan…

@theQR_editor @johncusack Listen to the interview (cool thing about nonpaywalled content is you can look beyond the headline). We talk about how outlets that unpaywall public records reporting and other public service stories end up getting more subscribers and making more money.

@johncusack God forbid journalists should be paid for their work? Not one person whined when they had to pay for a newspaper. Just because digital publication is the new norm doesn’t mean journalists don’t need to eat.

@OrinKerr The exception requires probable cause that Natanson violated the EA. Judges decide whether probable cause exists for warrants. Wouldn't the PPA probable cause element then have to be disclosed? What's the alternative? Officers just get to think probable cause into existence?

Am I missing something here? Otherwise this seems just a clearly bogus argument. (Maybe I'll blog it, if there's interest.)

Unless I'm missing something, this is just absolute nonsense. The law has an explicit statutory exception that clearly applies in this case. And even if it didn't, the PPA is not an "adverse authority," as it's utterly irrelevant to probable cause. nytimes.com/2026/02/05/us/…

@Mike___Kilo @FreedomofPress @theintercept He asked the judge to make the court sketch artist blur his face because someone might see the court sketch and track him down while maintaining a LinkedIn profile with his face on it. Nothing to do with any mobs.

Filming ICE is an act of journalism. Cell phone footage is vital source material for reporters who can’t be everywhere at once. Shooting, killing and other targeting of those documenting news is an attack on press freedom and all else good in the world.  startribune.com/videos-show-fe…

This looks very unconstitutional. That said, should @sethharpesq take it as an admission that it doesn’t currently violate federal law to name a high level officer involved in a legally dubious, already completed mission that was the biggest news story in the world?
Congressman Pat Harrigan@RepPatHarrigan

Targeting U.S. Special Operators after a classified mission is beyond reckless. These are the men who operate in silence, take the highest risks, and go home hoping their families stay out of it, and some decided exposure was worth the clicks. I served in Special Operations, and I’ve seen how quickly names and images tied to sensitive missions turn into real-world threats. That’s exactly why I’m leading the Special Operator Protection Act with @RepRichHudson and @SenTedBuddNC to make doxxing America’s most elite warriors a federal crime.

That's quite a change of heart, @RepLuna.
Defending Rights & Dissent@RightsDissent

Rep. Luna knows her criminal referral for @SethHarpEsq runs afoul of the First Amendment. She previously cosponsored a resolution we supported calling for the charges to be dropped against Julian Assange. As the resolution acknowledged, Assange's prosecution for publishing classified information violated the First Amendment. While we agree with Luna's previous stance that publishing constitutes "regular journalistic activities" "protected under the First Amendment," we note Harp did not publish classified information.
