The Madhya Pradesh High Court has made it clear: A Muslim man’s second marriage during the subsistence of the first marriage does not amount to bigamy under Section 494 IPC, because Islam permits polygamy under Muslim Personal Law. The Court observed that Section 494 IPC applies only when the second marriage is legally void, and under Muslim Personal Law, such a marriage is not void merely because the first wife is still alive. However, the Court also clarified that the husband will still face trial for other serious allegations, including cruelty, assault and criminal intimidation.
