Daycare fraud is happening in Idaho right now and the AG can’t touch it… The program has existed since the 1990s. This bill doesn’t create it, doesn’t fund it, doesn’t expand it. Right now the Attorney General cannot prosecute daycare fraud. Providers are billing for kids who never showed up and nobody can go after them criminally. This bill changes that. The AG gets concurrent prosecutorial authority the moment this passes. Fraud stops being a paperwork problem and starts being a criminal matter. Providers hiring people not lawfully in this country get permanently removed from the program. There’s a hard sunset in 2028 forcing this legislature (not IDHW) to actively decide whether it continues. Any expansion requires us to approve it in statute first. None of that is how it works today. We heard this bill in Senate Health and Welfare today. Not everybody agreed. But think about what the program looks like tomorrow if this fails. Federal dollars still moving. IDHW still administering it on rules nobody voted on, providers who committed fraud still billing, the AG still watching from the sideline with nothing he can actually do. That’s the alternative. Not “no program.” Just the same broken version of it, running unsupervised. Minnesota didn’t set out to build a universal daycare apparatus. It just never got around to putting anyone in charge of it and it grew on its own until it didn’t look like anything they recognized anymore. That’s not what we’re gonna do here. No matter how anyone voted today, when we go home tonight the program still exists. It existed before we got here and it’ll exist after we leave. The only question was whether Idaho families get fraud enforcement and prosecutorial authority over the people stealing from them. I think they should. That’s why I voted yes.
