Western language limitations are so clear in this BAFTA discourse, because you can 100% say “sorry” to acknowledge harm and show empathy for someone’s pain EVEN IF IT WASN’T YOUR FAULT. Africans do it all the time using sorry-translated words like ndo, pele, ashia, pole, etc.

A magistrate is not legally qualified and for most offences (either way) the defendant gets to choose to be tried by a mag or by jury in the crown. Rape will always be tried by the crown. The crown offers many safeguards the mags don’t.

The danger of confirmation bias when the outcome can be deprivation of liberty is too great a risk. Look at the difference in conviction rates between magistrates and crown.

@Aintnopartylik1 @BarristerSecret I think jurors are more susceptible to believing their are more false allegations of rape then actually are, and other unconscious biases. Judges sit alone in family and immigration so having them sit as finders of fact and law would be no negative here.
