The key constitutional issue is not really “Was an autopen used?” but rather.. Did the president personally authorize the action? If the president approved it, many constitutional scholars argue the signature method itself may not invalidate the act. That’s part of why Gerald Ford’s preemptive pardon of Richard Nixon is often brought up in these discussions — because presidential pardon powers have historically been interpreted very broadly. So currently —No court has ruled Biden’s pardons void. No criminal charges have been filed over the autopen issue. The topic remains highly political and unresolved legally.

Not so fast Billy 😊 It is true that Richard Nixon resigned before criminal charges were filed. It is also true that the Supreme Court never directly ruled on the constitutionality of Gerald Ford’s pardon of Nixon. Therefore, it is accurate to say SCOTUS never definitively “resolved” the issue through a direct ruling on preemptive pardons. However, Article II Section 2 gives the President no preemptive power to pardon. The Constitution does not explicitly use the word “preemptive,” but Article II, Section 2 states the president: “shall have Power to grant Reprieves and Pardons for Offenses against the United States…” Critics argue Article II does not explicitly authorize preemptive pardons, while supporters point to historical practice and Supreme Court language interpreting the pardon power broadly. That language is why most constitutional scholars and legal historians believe preemptive pardons are likely constitutional for federal crimes.

The debate doesn’t continue because the question of whether or not a preemptive pardon is constitutional was not resolved by SCOTUS here. Presidents can’t issue pardons after leaving office. The debate is whether preemptive pardons issued before charges exist were ever constitutional. When Gerald Ford pardoned Richard Nixon in 1974, Nixon had not been indicted or convicted. Ford’s pardon covered all offenses against the United States which he has committed or may have committed related to Watergate scandal. What keeps the debate alive is that the Supreme Court has never directly ruled on every modern scenario involving broad preemptive pardons.
