Gee, and there’s 200 years worth of gas just across the border in Pennsylvania and Ohio. Wonder why we’re not using it? “New England, which relies more on liquefied natural gas imported by ship than other parts of the country…”nytimes.com/interactive/20… via @NYTOpinion

@ProfSchleich @CSElmendorf Given the stated desire of his housing czar to bankrupt private owners so it can be taken over by the state, this makes perfect sense.

It’s 2037 and the 51-member Supreme Court has reversed its stance on abortion once again with a majority opinion, 11 concurrences, four partial concurrences, 17 dissents, five partial dissents, and 12 resignations. Media are reading the rulings and promise an analysis for the public next month. Six copies of the various rulings were leaked in the days leading up to the decision or decisions.

@GregoryMcNeal @OrinKerr @FoxNews It’s their sheeplike behavior, faithfully following the playbook of authorized protest that got them into law school, that is depressing.

I was the moderator for this discussion. The protests were planned days in advance and coordinated on Signal and Whatsapp. They started disrupting before the introductions were complete, they weren’t there to hear, listen, or question, they were there to disrupt in a coordinated manner.

No ICE, No KKK, No Fascist U.S.A.” NEW VIDEO shows profanity-laced chants filling the air outside UCLA while protesters inside heckle a DHS attorney speaking to law students. The agitators interrupted the conservative campus event by calling the guest speaker a “Nazi” and staging a walking out mid-speech.

What happens when trial lawyers twist the meaning of a centuries-old law? Businesses get hit with a lawsuit while plaintiff’s attorneys profit. Owners, employees, and consumers are left footing the bill. Read about the manipulation of public nuisance law: bit.ly/4cblyoJ

NYT has obtained and published seven internal memos by Supreme Court justices in February 2016 regarding application for stay of Obama administration's Clean Power Plan. I'm skeptical that the memos are as newsworthy as NYT maintains, but the fact that *someone* leaked them to NYT is very newsworthy.

@jfleming2870 You have a very strange understanding of the word collusion. As well as ignoring the main point of the article, which is - wait for it - settling for the limits of insurance. Useless to continue this dialogue.

@DanielDFisher That has nothing to do with the dumb conspiracy theory you were floating whereby plaintiffs' lawyers were negotiating with defendants over the fee or, indeed, doing anything that would reduce the total recovery for the class

This guy has made a career out of complaining about something he doesn’t even understand. Securities class actions aren’t claims-made. It’s a fixed common fund. So there is no negotiation with defendants about the fee. They’re indifferent. The court sets the percentage award.
Daniel Fisher@DanielDFisher

And strangely, the settlement nearly always equals the limit of insurance, with the main topic of negotiation how much of that the plaintiff lawyers keep as fees.

@jfleming2870 Tom Baker, infamous right-wing conspiracy theorist, on settlements and insurance limits: “In this murky environment, plaintiffs and defendants collude to pressure the D&O insurer to settle on terms that may not reflect the ultimate merits of the claim…”ir.lawnet.fordham.edu/faculty_schola….
