If he is found guilty and sentenced to prison that's another thing entirely, what if he is not guilty at the end of the day, all the time he was remanded cannot be returned to him. The thing you should know is this, the court will never want anyone to feel like they have the discretion to attend cases against them. Bail application to court is a way of giving the court guarantees that you are going to be present for your trial. If court don’t do that, those standing criminal trial will only come to court whenever they feel like it and that will stall the proceedings of court. That is why as a lawyer, when your client is charged, the first thing that should be playing on your head is to get him out on bail before anything else. Because when your client is granted bail, you are on a good road towards justice, so you have to apply for bail immediately, and push that the bail application is heard and in cases of this simple offenses, the court will grant bail with very liberal conditions. Then you work on perfecting your client bail and he goes home.
