A federal judge in Hawaii recently blocked enforcement of an Aloha State statute that criminalizes certain deepfakes about candidates running for public office. The ruling in Babylon Bee v. Lopez offers important First Amendment lessons for lawmakers about the need to narrowly draft such measures and the importance of safeguarding political satire. @ProfClayCalvert aei.org/technology-and…

Last week, Google was named in a lawsuit alleging that Gemini encouraged a man to take his own life. @ProfClayCalvert has been tracking AI liability in cases of chatbot inspired harm; one of his early works on this topic discussed a lawsuit alleging Character.ai of contributing towards a teen’s suicide, a case which examined topics courts are still navigating today. Instagram recently launched a new tool meant to alert parents when teens repeatedly search for terms similar to suicide or self-harm. As another child safety measure for social media, it is worth revisiting @ProfClayCalvert’s article from 2024, where he provides considerations for lawmakers on online child safety tools. Companion rulings by a federal judge in late December blocking enforcement of Texas’s App Store Accountability Act provide important First Amendment lessons to well-intentioned lawmakers about drafting legislation that ostensibly protects app-using minors on digital devices. @ProfClayCalvert aei.org/technology-and…

"Noble intentions, however, don’t give lawmakers a pass from complying with entrenched First Amendment principles that protect minors’ rights to access and engage with lawful speech, as well as the rights of app developers and stores to create and distribute vehicles for conveying such expression." @ProfClayCalvert @AEItech #childonlinesafety #kids aei.org/technology-and…

The latest from @ProfClayCalvert: “[US District Judge Robert] Pitman’s opinions represent free-speech victories for multiple stakeholders…Whether these wins will hold up on appeal with the sometimes social media-unfriendly Fifth Circuit remains to be seen.” aei.org/technology-and…

A Los Angeles jury will opine if Instagram and YouTube are responsible for teens’ mental health. On a new @TechPolicyPdcst, @ProfClayCalvert (@AEI) and @corbinkbarthold review the many problems with letting plaintiffs’ lawyers demagogue social media platforms before a jury.

“Lawmakers who do too little—who don’t do enough—to address a purported speech-caused problem may find their statutory handiwork deemed unconstitutionally underinclusive. I’ve previously addressed underinclusivity, but the December 2025 rulings in Griffin and Murrill add new light.” Read @ProfClayCalvert's new blog post: aei.org/technology-and…

"underinclusive laws “fail to materially cure or solve whatever problem supposedly exists.” Underinclusivity often “plagues laws that single out one medium . . . for conveying content . . . but that leave unregulated and unlegislated other varieties of media . . . to transmit the same content.” @ProfClayCalvert Statutory Underinclusivity and Social Media Platforms: First Amendment Lessons for Lawmakers aei.org/technology-and… @AEItech

Two recent federal court opinions blocking the enforcement of laws targeting social media platforms illustrate that lawmakers who do too little––who don’t do enough––to address a purported speech-caused problem may find their statutes are fatally underinclusive. @ProfClayCalvert aei.org/technology-and…

The KGM trial continues, with Mark Zuckerberg's testimony last week dominating headlines. While this trial is touted as the bellwether for lawsuits on social media addiction, it isn’t the first. Here are a few related lawsuits from late last year, with analysis provided by @ProfClayCalvert: aei.org/technology-and…
