The Supreme Court declined last week to block Texas's App Store Accountability Act, which requires age verification and parental consent for anyone under 18. The law stays in effect while the Fifth Circuit hears the appeal in early August. @ProfClayCalvert unpacked the district court opinion that first blocked the law, finding that it violated the First Amendment and failed strict scrutiny. The EU's General Court dismissed Apple's challenge to its gatekeeper designation last week. Apple argued it runs five App Stores, one for each device, and only the iOS one was big enough to qualify. The judges said they all do the same thing and brought them all under the Digital Markets Act. In May, AEI's Bronwyn Howell read the Commission's own review of the law, which found it fit for purpose and proposed no changes. The review relied on stakeholder submissions but included no apparent input from regulated companies or consideration of research finding that the DMA had chilled innovation. “Three insights arise from this discussion. First, from Japan comes the understanding that retiring copper moves the responsibility for power resilience from exchanges to individual consumer premises—arguably reducing communications resilience in the face of climate change and other environmental and geopolitical uncertainty. Second, from New Zealand comes a challenge to the assumption that fiber networks must be expanded to replace copper. Gigabyte speeds might be nice to have but are expensive, and the speeds obtained on fixed wireless and satellite are both cost- and application-effective. The Supreme Court ruled 6-3 last week that geofence warrants count as Fourth Amendment searches, handing privacy advocates a win in Chatrie v. United States. But the decision ducked the harder question of whether the warrant itself was valid, punting that back to the lower courts. After oral arguments in May, @Jim_Harper previewed almost exactly this outcome: a privacy-protective ruling that sidesteps cleaner property-rights reasoning and leaves little real guidance for future cases.
