On June 15, 2023, @0xTAY_ and I, successfully obtained a Mareva ("freezing") Order against a group of Defendants, referred to collectively as the “Boneheads team”. Our statement of claim alleges fraudulent misrepresentation, breach of contract, anti-consumer friendly and anti-competitive practices in relation to the sale of the Boneheads NFT, which was sold to “thousands of consumers across the world with a contract that originated in Ontario”. In what appears to be a first for Canada, the Ontario Superior Court of Justice allowed us to serve both the Mareva Order and Statement of Claim via an NFT airdrop into 13 cryptocurrency wallets alleged to be controlled by the Boneheads team as a means of notifying a fifth unnamed and unknown Defendant. This means of service was strongly supported by recent jurisprudence in the United Kingdom and United States where a similar Order was granted. Launching a class action as a sole practitioner has only been possible because of the support and encouragement I have received from members of the legal profession and my friends in the blockchain space. I specifically want to thank @zachxbt for his research and reporting on this as early as a year ago in bringing this matter to light. @cryptohaib @Uniswap man love seeing this. the howey test breakdown was very well explained.

Why @Uniswap cannot be a security: 1) #UNI was a free airdrop so the "investment of money" prong of the Howey test cannot be met. 2) It is impossible to know if your swap is going to a certain liquidity provider so any investment of money cannot be in a "common enterprise".

I recently described to Brendan Peters (my colleague who doesn't have X) feeling like we were in “no man’s land”. We were either treading where other lawyers, smarter and more experienced, had gone before us only to realize it was a dead end. Or we were breaking new ground.
