लगभग तीन दशक पहले की बात है यह ढाई दशक पहले की बात भी हो सकती है। विनोद दुआ अपने साप्ताहिक कार्यक्रम में अरविंद केजरीवाल से इंटरव्यू कर रहे थे अरविंद केजरीवाल को मैंने पहली बात उसी कार्यक्रम में ही देखा था। विनोद दुआ ने बताया किअरविंद केजरीवाल सूचना के अधिकार को कानूनी रूप देने के लिए एक बड़ी लड़ाई लड़ रहे हैं। केजरीवाल कांनून के बारे में विस्तार से बता रहे थे। अरविंद केजरीवाल ने बातों बातों में बड़बोलेपन में कह दिया कि इस लड़ाई में आप हमारा साथ दीजिए आप भी आइए। विनोद दुआ तत्काल भड़क गए और बोले "आप अपना काम करिए मैं अपना काम कर रहा हूं, आपको यह नहीं बताना चाहिए कि मुझे क्या करना है। मुझे आपकी राजनीति में कोई रुचि नहीं है" आज पता नहीं क्यों यह वाकया याद आया। केजरीवाल कोई समाज सुधार के लिए राजनीति में नहीं आए थे। वह सब बुराइयां उनकी पार्टी में भरी हुई थीं जो किसी राजनैतिक दल में होती है। चूंकि कांग्रेस, सपा आदि पार्टियां इस बात को स्वीकार करती है इसलिए बची हुई हैं, आम आदमी पार्टी अपने अस्तित्व को बचाने के लिए संघर्ष कर रही है।

AAPs leader in parliament, SS opposes merger. 3. AAPs national leader, AK opposes merger. Org structure will become a strong point of contention.

In this case, 7 nominated RS MPs have no backing, since the Pb assembly of AAP legislators have already approached Prez on their recall.

@t_mkat @iaxyan @ndtv @akhileshsharma1 @reetksahni So, we agree that original party case did mattered in the Sena case? Same will be argued here. Neither the state legislative assembly merged, nor did its leader in the upper house. AAP will try to prove it as defection on solid merits. Lets see.

@ArchieSriva @iaxyan @ndtv @akhileshsharma1 @reetksahni They're anyway not staking claim to be original AAP. 2/3 can move to different party or become independent. Let's not forget that despite from Shiv Sena chief, Thackeray lost claim to be the "original" Shiv Sena as the Shinde faction was larger.

I think Raghav Chaddha and others did not research the Anti Defection Law. Individuals cannot merge, only a party can merge with another party. They first needed to split the Aam Aadmi Party and create a new party of seven MPs and should have requested to Rajya Sabha Chairman to recognise them as a separate entity . Simultaneously they should have written to Election Commission for registering their party and allot one election symbol. The question of merger with any other party or BJP arises later. As long as the separate group is not recognised, the merger can be challenged in a court of law.

Recall, how CJI declared BJP Chandigarh mayor win illegal, & made AAP victorious? I hope that collective objection of Pb state assembly, AAP RS leader will be acknowledged at SC

In this case, my source of knowledge is not another person’s opinion, but the Constitution of India. I rest my case. Best wishes for the hearing in the Hon’ble SC, if it takes place.

@Bahubali2002 Yes, I agree but precedents are only set after such incidents come to fore. Same SC nullified electoral bonds, declared BJP Chandigarh mayor win as illegal & declared AAP mayor victorious. These are all examples of judicial activism, provided the aggrieved party fights it hard.

@Bahubali2002 @Gurpret_Sandhu6 @Gagan4344 Well, TDP gave up easily. AAP will fight it to the hilt. The 2/3rd rule is obviously wrong, esp in RS context. BJP can dance today, but it wont matter either if AAP retains Pb. These MPs tenure are expiring in another 20 months. Enjoy till then.
