There is no federal law that requires passengers to wear masks on airplanes. Article I, Section 1 vests all legislative powers in Congress, which means the Executive and Judicial branches cannot usurp lawmaking authority, nor can Congress delegate lawmaking authority to them.

Some Democrats in the Senate just abandoned Biden on airplane mask mandates. Hopefully we get a vote in the House. White House has already threatened to veto. We just filed a federal lawsuit against the CDC to stop this in the courts if it isn’t stopped in Congress.
