An employer has been ordered to pay Ksh 250,000 for refusing to show a former employee what they said about her in a background check. She believed a negative reference cost her a new job. When she asked for answers, the employer hid behind “confidential.” The ODPC said no. If you talk about someone, they have a right to see it. Employers must now choose their words carefully.
