No. The case against Gabehart and the case against Spire are very different. I think that Gabehart is already cooked on liability and the real open question as it relates to the case against him is if JGR can establish that they have suffered financial damages as a result of his conduct. The case against Spire will come down to what is obtained through discovery, including third-party subpoenas. Where the HMS partnership will be relevant would be as it relates to damages if JGR can prove its claims against both Gabehart and Spire. Specific to Spire, JGR has to both prove that Spire unlawfully interfered with its contract with Gabehart and/or violated trade secrets laws and that as a result, JGR suffered damages. For example, having access to JGR confidential information does not necessarily mean that damages occurred as a result. JGR would/will still have to establish how Spire having access to information caused JGR harm. A natural Spire counter argument would be presenting evidence that it used information it had from HMS via the alliance rather than JGR confidential information and thus JGR has suffered no harm. We are very early in the season, but right now that HMS has only won a race whereas JGR & 23XI (a team that has access to JGR confidential information) have won seven races is not exactly strong evidence to support a conclusion that it’s HMS data that is driving Spire’s success this year as opposed to access to confidential JGR information via Gabehart.

@SMMHansen I was listening to denny's podcast and he talks about spire and how much they lean on Hendrick. I question if this has any implications on the lawsuit at this time.

He got away from ppl to clear his head, mourn, whatever. If he wanted it to be about him, he'd go do interviews like everyone else (they aren't making it about them, just my point)

@Larry828207955 @cabanascar42 He didn't go in front of media. He didn't do something crazy. He just went for a walk to clear his head. Kyle helped him to be where he is today. Kyle was significant in his life. There are fans crying nearly as much as the family. You think there won't be drivers doing the same?
