@Gurpret_Sandhu6 @Gagan4344 Not that simple, neither did the original party not its leaders accede to such a merger. That too in RS, where these 7 MPs were nominated, not elected. Punjab’s state legislative assembly wasn’t consulted, supreme court will acknowledge that.

@Gagan4344 This will not help; Recall is nowhere mentioned in the Constitution. They're fulfilling the two-thirds split requirement under the Anti-Defection Law, mentioned under the 10th Schedule.

I concur. The constitutionality & powers of Punjab legislatures must be respected. You can’t get elected by them & then go rouge against same party. That’s a clear violation of the elected assembly, which sent you to RS in the first place.

@ashok_advocate Constitutional exercise is on the part of the elected legislative assembly of the state. Which sent these people to the RS from its quota, without its consent & approval such a merger shall deemed illegal. Original party & its leader dint accede to the merger either.

When a two-thirds majority chooses to merge, it isn't intimidation, it is a constitutional exercise of choice under the 10th Schedule. Accountability isn't murdered by mergers; it is strengthened when leaders prioritize national progress over internal party dysfunction. The law is being followed, not murdered.

Supreme court must acknowledge the constitutionality & powers of the elected state legislative assembly, upon whose recommendations members are nominated to RS.
Nominated members merging in opposition, going rouge is a direct assault on the mandate of people. Should be nullified

In this case, both are non existent. Raghav & BJP have only bought time until SC nullifies it. Short term they’ve won!
