هذا حكمها حكم تارك الصلاة متعمد لان الصلاة فرض على المؤمن لقول النبي صلى الله عليه وسلم "بين الرجل وبين الشرك والكفر ترك الصلاة" لقوله تعالى ﴿إِنَّ الصَّلَاةَ كَانَتْ عَلَى الْمُؤْمِنِينَ كِتَابًا مَوْقُوتًا﴾ [النساء: 103]. معنى الآية أن الصلاة فريضة ومكتوبة ومحددة بأوقات معينة ولا يجوز تأخيرها عن وقتها إلا لعذر شرعي. عذرهم كان النوم و قال النبي صلى الله عليه وسلم "من نسي صلاة أو نام عنها فكفارتها أن يصليها إذا ذكرها" و حسب قول الشيخ عثمان الخميس ان الانسان اذا كان يتعمد النوم و يفوت الصلاة مثل السهر ليلا فباطلة صلاته
