Feeling threatened, Henkle drew his handgun and fired several shots. He hit Mozee in the arm, but one round also struck an innocent bystander who was driving past in the left lane. Henkle was originally charged with criminal recklessness with a deadly weapon, while Mozee faced a misdemeanor battery charge.
