There is a huge, controversial topic that many people get completely wrong.
For a very long time, people believed that once a woman says I do at the altar, she can never say No to her husband in the bedroom.
Many people still quote old laws saying a man cannot be accused of ræping his legally wedded wife. But wait! Is that still true in Nigeria today?
The short answer is: It depends entirely on the state where you live!
The Old Law: The Criminal Code and Penal Code. If you look at our oldest federal laws the Criminal Code (used in South Nigeria) and the Penal Code (used in North Nigeria) they both state that a man cannot legally rap£ his wife.
The Reason: These old laws were written based on ancient colonial rules. They believed that marriage gives the husband permanent consent to his wife’s body. Under these old laws, if a husband forces himself on his wife, the law does not call it ràp£. At most, it could only be called assault.
The Game Changer: The VAPP Act
Because those old laws failed to protect women at home, the government passed a new, powerful law called the Violence Against Persons Prohibition (VAPP) Act.
What the VAPP Act Says: This modern law completely removes the protection for abusive husbands. It makes it clear that consent is key, even in marriage.
Under Section 1 of the VAPP Act, if a husband forces his wife to have $ex using violêncë, thr£ãts, or fear, it is a crime! The law sees it as râp£, and an abusive husband can be sent to prison for it.
The Problem: Not All States Have Adopted the VAPP Law!
Here is the twist that every Nigerian must understand. The VAPP Act is a federal law, meaning it was originally made for Abuja.
For it to protect you in your own state, your State Government must domesticate (accept and pass) it into law.
The Progress: Over the years, a vast majority of Nigerian states have successfully adopted and signed the VAPP law to protect their women from domestic sexual abuse.
The Danger: There are still a few states in Nigeria that have not fully adopted or domesticated the VAPP law yet! In those specific states, the old Criminal or Penal codes still apply. This means in those areas, a woman cannot legally report her husband for marital ràp3; she can only report him for physical beating (assault).
THE TAKEAWAY FOR EVERY WOMAN:
Your body belongs to you, and marriage is built on mutual respect and love, not force.
Knowing your rights depends heavily on the specific state laws where you reside. If you are facing abuse, always speak out and reach out to local human rights groups!
