Is the situation significantly different now? → Yes, it's completely different. The decisive reasons for the different situations are as follows. 1. Partner Risk: The essence of the BUSD crisis was less about issues with ‘Paxos’ itself and more about risks associated with a specific partner, ‘Binance,’ which was facing regulatory pressure globally at the time. NYDFS pointed out that Paxos failed to properly supervise Binance's anti-money laundering (AML) compliance. USDH is not linked to partners carrying such specific risks. 2. Changing Regulatory Landscape (GENIUS Act): During the 2023 BUSD incident, it was a ‘grey area’ with no clear federal law and overlapping regulations from individual states. However, the ‘GENIUS Act’ now establishes the first federal stablecoin regulatory framework in the U.S. This provides clear ‘rules of the game’ for stablecoin issuance. Paxos is one of the most fully prepared companies to comply with this new legislation, possessing a New York trust license and currently preparing for federal trust authorization. Could USDH also fail due to the BUSD failure case? → The possibility is very low. In fact, the BUSD incident can be seen as a case that demonstrated Paxos' crisis management capabilities. Following regulatory orders, Paxos orderly scaled back its operations while safely redeeming over 20 trillion won worth of stablecoin (BUSD) at 100% without a single victim. This ironically underscored its ability to safeguard customer assets even in the worst-case scenario. In conclusion, the BUSD incident resulted from the convergence of a specific partner and an unclear regulatory environment in the past. With clear legislation (the Genius Bill) and a new partner (HyperLiquid), USDH is highly unlikely to fail for the same reasons.
