SEC Commissioner H.M. Pierce: “The Journey Begins” TL;DR: This is a long post on US Crypto Regulation. Boring. 99.9% of CT won’t read it. If you do, you’re built differently. @HesterPeirce is leading the SEC Crypto Task Force, and this is an important factor in helping the industry see more crypto-friendly regulation in the US. 🔳How do we know this? Among many things, I want to highlight one here. In 2021, Commissioner Pierce wrote the Token Safe Harbour Proposal (link below), which never came into fruition as the previous administration had no interest in supporting crypto. The proposal was welcomed by the crypto community and was seen as crypto-friendly because it offered a three-year grace period for developers to build decentralised networks without triggering securities regulations, allowing more flexibility and legal certainty for crypto projects. 🔳OK, what now? Commissioner Pierce just published, yesterday (4th February), a statement on what she calls: "The Journey Begins". This refers to what the new SEC Crypto Task Force is working on. I personally got excited when I saw the news but then hit a wall. There are no explicit deadlines mentioned for when the Task Force will complete its work. However, the text does acknowledge that resolving crypto regulation will take time and urges patience. 🔳So how long could this take? To find some potential answers, I went back to the Executive Order related to the crypto sector issued on 23rd January 2025: Strengthening America's Leadership in Digital Technology. @punk6529 called this: “This is the single most impressive government document/order/guidance about crypto ever written. I have had the pleasure/displeasure of having read basically all of them, from every country in the world, over the last 10+ years. Absolutely incredible work.” I can only agree with his take if we look at some important elements. 🔳Executive Order key timeframes ---------------------------------------------------------- “Within 30 days of the date of this order, the Department of the Treasury, the Department of Justice, the Securities and Exchange Commission, and other relevant agencies, the heads of which are included in the Working Group, shall identify all regulations, guidance documents, orders, or other items that affect the digital asset sector.” ---------------------------------------------------------- “Within 60 days of the date of this order, each agency shall submit to the Chair recommendations with respect to whether each identified regulation, guidance document, order, or other item should be rescinded or modified, or, for items other than regulations, adopted in a regulation.” ---------------------------------------------------------- “Within 180 days of the date of this order, the Working Group shall submit a report to the President, through the APEP, which shall recommend regulatory and legislative proposals that advance the policies established in this order.” ---------------------------------------------------------- The SEC Task Force is part of the above Working Group, so while Commissioner Pierce has not given any indications on dates, we can make an estimate of what potential deadlines we could see. 🔳Now let's look at the key items the Task Force is focusing on motioned in the "The Journey Begins". ◽️Security Status of Crypto Assets: Determining which crypto assets fall under securities laws is fundamental. They aim to resolve regulatory uncertainty that has left many projects in limbo, such as Ripple $XRP, @coinbase Staking & Earn Programs, @Uniswap liquidity pools or governance tokens, @binance & BUSD stablecoin (SEC sued Binance in 2023, alleging its $BNB token and $BUSD stablecoin were securities), etc. ---------------------------------------------------------- ◽️◽️Defining the SEC’s Jurisdiction: The Task Force is working to identify areas that fall outside of the SEC’s authority. No-action letters are encouraged to clarify regulatory boundaries. ---------------------------------------------------------- ◽️Temporary Relief for Coin & Token Offerings: The Task Force is considering a proposal for prospective and retroactive relief for token issuers that provide transparency. This would allow certain tokens to trade freely until permanent rules or legislation are established. This is a sticky point that has divided CT. While @lex_node said: “Very bullish idea here… SEC listening, it is acting fast on what it hears!” others reacted differently. Especially the post made by @DegenerateNews: “BREAKING: SEC COMMISSIONER HESTER PEIRCE STATES ‘IF PEOPLE WANT TO BUY A TOKEN OR PRODUCT THAT LACKS A CLEAR LONG-TERM VALUE PROPOSITION, THEY SHOULD FEEL FREE TO, BUT SHOULD NOT BE SURPRISED IF SOMEDAY THE PRICE DROPS’, got a large CT attention. @PopPunkOnChain’s reaction was: “Rug pulls are legal. Crime is legal.” ---------------------------------------------------------- 🔳Other Key items to note: ◽️Improving Paths for Registered Offerings: Exploring ways to make Regulation A and crowdfunding rules more viable for token offerings. ◽️Updating Special-Purpose Broker-Dealer Rules: Expanding the scope of special-purpose broker-dealers to include custody of both security and non-security crypto assets. ◽️Clearer Rules for Crypto Custody: Working with investment advisers to establish a safe, legal framework for custodians crypto assets. ◽️Crypto Lending & Staking Clarity: Evaluating whether staking and lending services are subject to securities laws and how they should be structured. ◽️Crypto Exchange-Traded Products (ETPs): The SEC is reviewing new ETP applications and considering modifications to existing ones, such as: Allowing staking, In-kind creations, and redemptions. ◽️Clearing Agencies & Transfer Agents: Addressing how blockchain-based clearing and settlement systems fit within existing regulations. ◽️Cross-Border Sandbox for Crypto Innovation: Considering ways to facilitate international crypto experimentation on a limited, temporary basis. ---------------------------------------------------------- Huuh. Hard to digest all of this in one go. Anyway. I won't go into all of the above details as @0xASK did it extremely well in his recent post (700k views): “America's first-ever Crypto Czar just held his first press conference and said they are going to create a 'Golden Age For Digital Assets' in America.”👀 Going back to my question on how long until we see something, while the SEC Crypto Task Force has not provided clear deadlines yet, the process has been accelerated, and we should expect news to roll out in the next 180 days. Thoughts on #WebSummit so far: Very well-organised. For businesses with a stand, the brand exposure is massive. AI is the leading topic. The summit app is fantastic for networking.
