@tylermeredith I think a problem though is that the auditors are either not well trained enough, or simply not as competent and experienced as the accountants and lawyers they are matched up against. They often look in the wrong areas with flawed procedures and get nowhere.

The issue with people who prepare their own taxes is they don’t know what they’re doing wrong.
Came across someone that prepared their own personal tax return. He made a mistake.
He bought a second home and converted his original home to a rental property.
There are tax consequences when you change your home from personal use to income earning. He didn’t realize. We were able to rectify the situation with minor impact because he came to us about a separate issue shortly after he changed the use.
But if he never reached out, he could have faced $16k worth of penalties (+ interest) in the future.
Unless you’re very familiar with most of the rules and keeping up to date on latest developments (which frankly speaking, it’s rare someone even does this in their own profession), you’re likely making mistakes or missing out on savings.

@Lovetosail Under the current rules, when Mom and Dad retire, they are exempted from the first $2.5 million worth of capital gains on the farm, with options to defer the balance. This discussion is not about the typical family farm.

If you're wondering why people are mad at me today, it's this. Interestingly, you never hear much about the families passing down or divesting of less land value because they benefit from the increased lifetime exemption that was part of the new capital gains rule.

The farms discussed in the research cited here accrued between $10 and $15 million dollars in capital gains on land between 1996 and today. $370-500k in capital gains on land per year. Farms are worth 10-12x what they were in 1996. In case you were wondering.

@adamvettorel Incorporate a company, sell the property to said company, lock in your 50% capital gain. Property never reaches the market and you aren’t paying the extra tax. Pretty simple.
