I am introducing a Constitutional Amendment to end Birthright Citizenship. Under current interpretations of American law, anyone born on American soil automatically becomes a U.S. citizen, regardless of whether the parent was here legally or not. This is wrong and not at all the intent of those who wrote the 14th Amendment. We are a country filled with immigrants, and legal immigration is valuable and should be protected. But we are also a country whose borders have been too open and our generosity exploited too often. President Trump has moved to seal our border from illegal immigrants more than any other president. But we will have more to do. We need to make sure that only children born to legal residents of the U.S. are automatically citizens. I have supported protecting birthright citizenship from abuse since the beginning of my tenure in the Senate, when I cosponsored the Birthright Citizenship Act of 2011, and now I am proposing an amendment to protect United States citizenship in case the Supreme Court fails to address this issue correctly.

This decision correctly upheld the plain text and historical meaning of the 14th Amendment’s Citizenship Clause.
Although what they ruled on was a shitty clause, That is precisely what SCOTUS is meant to do. SCOTUS’s role is to interpret the Constitution as written, not fix policy problems via executive action.
President Trump always knew The executive order was an improper unilateral rewrite of settled constitutional and statutory law.
I said it yesterday… this requires Congress or a constitutional amendment.
And we just happen to have that in Congress right now. Been sitting since January 2025.
I’m not sure why… but I feel like this is working out exactly how it is supposed to.

Two options left: 1. What SHOULD HAPPEN— The better and more PERMANENT solution — a constitutional amendment (2/3 vote in both houses of Congress + ratification by at least 38 states). This is extremely difficult.. and ironically, such a legislative attempt exists right now — the Birthright Citizenship Act of 2025 (H.R. 569), which seeks to redefine “subject to the jurisdiction” in statute. It was introduced in January 2025 and referred to committee but has not advanced significantly. 2. If the above fails, the only other way is the Military. It is 10pm and Thune just got unanimous consent (meaning not one senator objected) for the Senate to adjourn 19 days (July 13th) meaning the Senate is going home after tonight’s votes.
I will not be voting to re-open the floor until the Senate gets back to Washington. The Senate is literally running and not ONE senator objected to going on vacation before 4th of July.
John Thune is running and hiding because he doesn’t want to get voter ID across the finish line.
