Our client Gary Cushnie spent more than a week in hospital after returning home from holiday in Cuba and was diagnosed with Legionnaires’ disease. Neither he nor his partner Julie had any idea what had caused him to fall so ill on their two-week holiday until he received the diagnosis on returning to the UK. The first of two hotels they stayed in had clearly been recently decorated, and when Gary used the shower after arriving, it 'coughed and spluttered' before water began to run freely. He began suffering from chest pains, shortness of breath and a loss of appetite which left him feeling ‘totally exhausted' days later. Now, following legal representation from Hudgell Solicitors, he has been compensated by package holiday specialists TUI, who agreed a five-figure, out-of-court compensation settlement. Covid-19 Public Inquiry chair Baroness Hallett today said that 'those who were damaged by the vaccine rather than protected deserve proper recognition' in her latest findings and recommendations report. Groups representing vaccine injured people said they had waited five years for official recognition of the harm caused, and welcomed her call for reform of the Government’s current system for financial redress, the Vaccine Damage Payment Scheme (VDPS), which she said ‘is not sufficiently supportive’. Solicitor Terry Wilcox, of Hudgell Solicitors, who represents vaccine injured groups, said: "The Inquiry has today finally officially recognised that many people did suffer serious illness, and others died, as a result of having Covid-19 vaccines. “As Baroness Hallet said, in a situation where there is an emergency nation-wide vaccination programme, when people are asked by the Government to be vaccinated, there must be appropriate support for those who suffering side effects. “This has simply not happened to date for thousands of people and we now need to see the recommendations followed out as a priority." Hudgell Solicitors are representing several passengers who were injured during turbulence on a British Airways flight from Los Angeles to Heathrow. The aircraft allegedly plummeted around 6,000 feet during the incident in January. Passengers have told how they feared they were going to die, as they were ‘flung out of seats’ before crashing back down, suffering whiplash type injuries whilst some were left ‘covered in blood’. One passenger, who wishes to remain anonymous, believes injuries could have been avoided had the ‘fasten seatbelt’ sign been switched on when they started to experience turbulence. “I literally thought we were going to die. Campaign groups representing those who suffered ill health – and lost loved ones - after having Covid-19 vaccinations say a Public Inquiry report on Thursday must acknowledge the ‘reality of the devastating and life-changing impact’ on thousands of people. Representatives of Vaccine Injured Bereaved UK (@VIBUK_Official), @ukcvfamily and the Scottish Vaccine Injury Group, gave evidence to the Inquiry and are calling for clear formal recognition of those impacted. They also want the development of a dedicated care pathway, transparency around whether earlier action could have prevented harm and saved lives, and reform of the Government’s Vaccine Damage Payment Scheme (VDPS), which they say offers too little, too late, to too few. The groups are represented by solicitor Terry Wilcox, of Hudgell Solicitors, who says they have 'been continually silenced and ignored' and 'deserve acknowledgement of the impact on their lives', with 'changes made to ensure they are properly supported, and that lessons are learned for the future.' Solicitor Caroline Murgatroyd has provided an update on the legal work our team is doing for families of children harmed by surgeon Yaser Jabbar at Great Ormond Street Hospital. Speaking on our 'Righting Wrongs' podcast, she explained that to date, Great Ormond Street Hospital for Children NHS Foundation Trust has made no admissions as to liability for any injuries caused - and that recent review findings of harm caused 'do not constitute admissions of liability'. However, she says Hudgell Solicitors are bringing civil claims on behalf of patients, and hopes they will result in 'prompt admissions of liability and interim payments of compensation.' Friends and family of Emma Booth are fundraising to help her make lifelong memories with her children after being told her breast cancer has spread and is now incurable. Emma, 46, of Hull, has been battling triple negative breast cancer since 2021. It required her to have a lumpectomy in 2022 and a mastectomy in 2024. She had been in remission but in January was given the heartbreaking news that not only had the cancer returned, but had also spread. Her consultant at Castle Hill Hospital in Cottingham has also admitted that a growth in her lung should have been investigated with greater urgency, following a CT scan last September. Solicitor Elizabeth Maliakal spoke to BBC Look East about the need for all health professionals involved in the care of Jack Moate, at Addenbrooke's Hospital, to provide evidence at an Inquest into his death later this year. It comes after independent experts concluded that “fatal physical harm was caused” to Jack as part of an ongoing review of hundreds of patients treated by surgeon Kuldeep Stohr. Jack died in November 2015 – less than two months after Ms Stohr had operated on him. An Inquest into his death was opened and adjourned on Tuesday. His mother was told in 2015 that Jack's cause of death was deep vein thrombosis, cerebral palsy alongside epilepsy. Hudgell Solicitors are to ask a coroner to call Addenbrooke’s Hospital surgeon Kuldeep Stohr to appear and give oral evidence at the Inquest into the death of a nine-year-old boy she had operated on. The conviction of former Lancashire sub-postmaster Steve Marston has become the second 'Capture' case referred to the Court of Appeal by the Criminal Cases Review Commission (CCRC). Despite the Government’s commitment to overturning convictions related to Capture, the first case referred to the Court of Appeal, that of former sub-postmistress Patricia Owen, is facing opposition from the Post Office. Solicitor @NeilHudgell said: "I’m so pleased to see Steve’s case referred as he is a very decent man who deserves an early end to this process, but now we have to wait to hear how the Post Office responds. “Nothing can be taken for granted just yet. A hospital trust at the centre of two high-profile investigations has agreed to pay a £1 million legal settlement after it admitted doctors failed to diagnose that our client had suffered a stroke. Lisa, from Bishop’s Stortford, was 31 at the time and says she was told she had likely been suffering from stress and was sent home from Addenbrooke’s Hospital. She went on to have a second stroke that left her confined to a wheelchair for a year and with ongoing mobility issues. Cambridge University Hospitals NHS Foundation Trust, currently under patient safety investigations relating to suspended orthopaedic surgeon Kuldeep Stohr and its neuroscience unit, admitted a breach of duty of care. Lisa was represented by Hayley Collinson, of Hudgell Solicitors, who said: “This was an utterly preventable situation in which basic mistakes at Addenbrooke’s have been exposed. On World Cerebral Palsy Day, we’re not just helping to raise awareness of this often-overlooked condition .. we’re also saluting those inspirational individuals who’ve learned to live with the disability – and simply refused to let it hold them back. One of them, Caprice Haughton, is a solicitor in our medical negligence team. Diagnosed with CP when she was just two, Caprice endured years of hospital trips, surgeries and physio … but never let go of her ambition to become a lawyer. What a powerful evening at the London School of Economics. I was honoured to be part of the panel discussion on “Mass media, justice and me: a victim’s perspective.” The conversation was honest, challenging and—most importantly—grounded in real lived experience. The feedback from those in the room afterwards meant a lot. It was also a pleasure to finally meet @The_Real_JSP and to spend time with the incredible @JoHamil73963257 whose strength and resilience following the Post Office scandal is nothing short of inspiring.
