She had to either purposely demand of the AI that it produce only favorable case law, which it will produce by fabrication, or she had to ask it for relevant case law and strip away only the unfavorable case law for being fictitious, willfully leaving in the fictitious favorable citations. Your brain's executive functioning and cognitive ability don't have to be firing on all cylinders for you to have done something intentionally and with purpose.
