The man driving the Durango had a blood alcohol level of .19 — nearly three times the legal limit. He also had cocaine in his system. He walked away from the crash alive. Now go back four months. March 2025. Police arrest him for drunk driving. He is released. April 2025. Police arrest him for drunk driving. Again. He is released. Again. Two DUIs in two months. Two chances to take this man off the road. Two times the system opened the door and said: try again. Go back further. June 2023. He was arrested for domestic violence. He was released. He was not supposed to be in this country. He had entered illegally. No valid license. No legal right to be on that road on that night in that lane doing sixty toward that car. Two DUIs in sixty days. A domestic violence arrest before that. And not once — not one single time — did anyone in the system say: this man should not be here. Not the court that processed his DUIs. Not the state that let him walk twice. Not the country that never came looking. A toxicology expert later testified that based on how fast alcohol leaves the body, his actual blood alcohol at the time of impact was approximately three times the legal limit. Three times.
