The state of legal immigration in the U.S.: Absolute chaos. -Employer-sponsored green card paths are tenuous. PERM is broken, with 15+ month adjudication times. NIW filings are surging, and I suspect EB-1A filings are too. -Family-based cases are facing more scrutiny. The country bans and adjudicative holds are taking their toll, and who is affected remains extremely confusing. -People with legitimate cases are paying filing fees while seeing little to no service rendered. Costs are rising for both practitioners and clients. -Immigration judges are being fired and replaced with inexperienced, politically favorable appointees. -The bright spots: litigation is working. O-1s are still moving. E-2s remain a viable path. But overall: legal immigration is becoming more expensive, more unpredictable, and more chaotic.

BREAKING update on the USCIS benefit adjudication pause/holds: USCIS posted that have lifted the adjudication pause holds for non-citizens in the following groups * vetted through Operation PARRIS, * certain petitions filed by U.S. citizens (not clear which ones or if it is case by case, * intercountry adoption forms, * certain rescheduled oath ceremonies, * statutory and regulatory decision issuance {I have absolutely no idea what that is * refugee registrations for South African citizens/nationals * certain special immigrant visa petitions, certain employment authorization documents * asylum applications from non high-risk countries, and * "applications associated with medical physicians". "We continue to review all application types and lift holds for both individual and group cases as appropriate."

🚨 BREAKING: In Doe v. Trump, a federal judge in Massachusetts just dealt a major blow to USCIS’s indefinite pause policy, which applies travel-ban logic to legal immigrants already admitted and living inside the U.S. The judge joins at least seven other federal judges who have found the policy likely unlawful, arbitrary, and capricious. She went further by ruling that using country of birth as a negative factor in immigration decisions is also likely unlawful. The court rejected USCIS’s attempt to freeze immigration benefits for people who followed the law, including many who have lived here legally for years, some for over a decade. Since December 2, this policy has wreaked havoc on the lives of thousands of physicians, scientists, highly skilled immigrants, and spouses of U.S. citizens from 39 countries, stripping them of any legal means of employment and extension of lawful status through indefinite administrative delay. In her ruling, the judge wrote: The policy “extends far beyond” entry restrictions and targets people already living legally in America. USCIS failed to consider the human cost of “throwing thousands… into indefinite limbo.” “Indefinite limbo… affecting all manner of life plans.” “Extrapolating the conduct of two individuals… to thousands… does not rank as reasoned decision-making.” The policy “runs afoul of… prohibition on nationality-based discrimination.” Clear message from the courts: legal immigrants who are already admitted and living inside the U.S., and who followed every rule, cannot be collectively punished solely because of where they were born. Early in my career as an immigration lawyer I casually mentioned to a client of mine, an engineer from India, in H-1B visa status that it seemed like Indians had a natural ability to excel in math and science. I will never forget his reply, “Bob, we have plenty of dumb people - perhaps more dumb people than the entire population of the United States. But you will never deal with them.” ••• Maybe it was a politically incorrect way to say it but if the US is able to “recruit” the top 10% of every country and those people come and bring their work ethic and ability (and gene pool) — it is just really weird why we would fight that because basically no other country in the world can do that. The top 10% of hard workers and brainpower from India and China constitutes a lot of people. •••
