Summer just started and the weather finally cooperated, so I ended up at the beach on a whim. Met some cool people, laughed a lot, and honestly had way more fun than I expected. Took a few pics too — “stomach in” like rent was due. 😅

Kumusta po kayo? Sagutin ko na po ito nang hindi pasigaw, since may sufficient legal background naman ako dahil nagtuturo ako ng Law on Obligations and Contracts. Sa batas, Article 1174 of the New Civil Code in particular, ang force majeure ay itinuturing na isang event that “could not be foreseen, or which, though foreseen, were inevitable.” Sa Tagalog, “hindi inaasahan o kung ito man ay inaasahan, ay hindi maiiwasan.” Ngunit, hindi dahil may force majeure na, maaari na natin itong gamitin bilang dahilan upang baguhin ang existing rules o sabihing balakid ito para magampanan ng isang tao ang kanyang tungkulin o obligasyon. Upang maging applicable ang force majeure, may apat itong requisites: (1) The cause of the unforeseen and unexpected occurrence or of the failure of the obligor to comply with its obligations was independent of human will (ang sanhi ng hindi inaasahang pangyayari, o ng pagkabigo ng may obligasyon na tuparin ang kanyang tungkulin, ay malaya o wala sa kontrol ng kagustuhan ng tao); (2) It was impossible to foresee the event or, if it could have been foreseen, to avoid it (imposible na maasahan ang pangyayari o, kung sakaling maasahan man ito, imposible itong maiwasan); (3) The occurrence rendered it impossible for the obligor to fulfill its obligations in a normal manner (dahil sa pangyayaring ito, naging imposible para sa may obligasyon na tuparin ang kanyang tungkulin sa normal na paraan); and (4) Said obligor was free from any participation in the aggravation of the injury or loss (ang taong may obligasyon ay walang kinalaman o hindi nakibahagi sa pagpapalala ng pinsala o pagkawala). Hindi rin dahil applicable ang force majeure sa isang sitwasyon ay pwede na itong basta-basta gamitin sa ibang sitwasyon. Ngayon, gamitin natin ito sa kaso ni Senator Bato. Kunwari gagamitin itong ground para payagan siyang bumoto online habang ang ibang mga miyembro ng Senado ay physically present sa isang pagpupulong. Sa tingin ko, hindi pwede. Walang force majeure na masasabi. Una, ang sanhi ng pagkabigo ni Senator Bato na tuparin ang kanyang tungkulin ay hindi independent of human will. Walang pumipigil sa kanya na pumasok sa Senado. Siya mismo ang umiiwas pumasok. Pangalawa, dapat ang mismong force majeure ang dahilan kung bakit imposible para sa kanya na makapasok. Ano ang kinalaman ng mga sinasabing giyera sa pagpasok niya sa Senado? Bakit ngayon lang ito binanggit? At kung totoo man, bakit siya lamang ang hindi makapasok? Bakit ang ibang mga senador ay nakakadalo naman? Kailangan tandaan na ang force majeure ay dapat magdulot ng actual impossibility, hindi mere difficulty, inconvenience, o personal preference lamang. At huli sa lahat, bakit hindi ilagay sa resolution ang tunay na purpose kung bakit kailangang baguhin ang rules? Kung may sapat na basehan, bakit kailangang madaliin? Bakit hindi pwedeng pag-usapan nang maayos sa plenaryo? Bakit hindi na lamang sagutin ang mga tanong ng mga kapwa senador? If the amendment is supported by compelling institutional necessity, then transparency as to its purpose should not be difficult to provide. Hindi dapat binabago ang rules dahil lamang gusto ito ng mas nakararami. May proseso ang institusyon ng Senado. Galangin natin ito. Okay? Okay.

And now Dela Rosa is reportedly no longer in the Senate after taking refuge there… so nasaan na siya ngayon? This is why the “ICC has no jurisdiction” script is so tiring. Hindi porket umalis ang Pilipinas sa ICC in 2019, erased na lahat ng nangyari before that. That’s not how this works. The issue is about alleged crimes during the period when the Philippines was still under ICC jurisdiction. So if Dela Rosa is really innocent, then face the process. Answer the case. Fight it legally. But hiding, running, technicalities, and loyalist excuses? That doesn’t scream “innocent.” That screams “please don’t make me answer.”

Watching people defend Bato, Robin, and Alan right now is honestly exhausting. I’m not even the type to be loud about politics online. I don’t worship parties, colors, camps, or candidates. I’m pro-Philippines. That’s it. But grabe! How much more obvious does it have to get before people stop doing mental gymnastics? The facts can be right there. The contradictions can be right there. The whole thing can be staring us in the face, and some people will still bend reality just to follow their beliefs. At this point, even if these politicians admitted things themselves, some people would still find an excuse. “Napilitan lang.”

Believe it or not… this was my first 10K ever. At 30 years old 😂 I’ve always wanted to run a marathon someday, but the funny thing is, I’ve always hated cardio. Like, I could barely run 1 km without stopping or walking. Plus I’m flat footed, so running always felt extra hard for me. About 2 months ago, I told myself I’d try running 1-3x a week. Nothing crazy. Just start with 1K, maybe 3K, maybe 5K. I even bought a new pair of runners to help make it feel real. And honestly… it’s been rough. I still get tired easily. My soles and calves get stiff, sore, and crampy. I don’t even know if my running form is right. I just kept doing it anyway. Today, the weather was too good, so I went out for what I thought would be a quick run. Then somehow I was already 2 miles in and still running without stopping. Around mile 3, my feet started hurting, so I walked. Mile 4 — I saw this beautiful Chicago skyline view, stopped for a photo, and decided to turn around and head back. It ended up being 11.4 km. Prolly 60% run - 40% walk. But it was my first 10K… and I’m proud of that! 🏃🏼‍➡️ My legs are sore AF right now. Sometimes progress doesn’t look like suddenly becoming good at something. Sometimes it just looks like continuing to do the thing you used to avoid. First 10K done.
