I know the last decade under the Trudeau-NDP was difficult and Albertans have every right to be frustrated. But thanks to the leadership of Albertans, the tide is finally turning in our favour. The vast majority of Trudeau’s ‘9 bad laws’ have been scrapped or reformed. Investment has begun flowing back into energy, tech, and agriculture, and we are creating more jobs than the rest of the country combined. Now is not the time to give up hope. Now is the time to double down and help Canada reach its incredible potential. With Alberta leading the way, we can turn Canada into one of the most strong and prosperous economies in the world. On October 19, I will be voting for Alberta to remain in Canada. I hope you will join me in doing so.

Dear Premier Smith, A referendum to have a referendum… after two justices told you, you could call Mitch Sylvestre’s question under Section 1 of the Referendum Act is hardly decisive or honest leadership. On Thursday you lied to everyone in Alberta when you falsely claimed you couldn’t use either Lukaszuk’s question or Mitch’s question because of “the courts”. The courts in fact said the opposite. Chief Alan Adam had his picture taken SIGNING the Lukaszuk petition. How would he oppose THAT question. The simple fact is that you promised Mark Carney that there wouldn’t be a vote on independence this year. By stabbing 301,620 of YOUR VOTERS in the back you delivered on the promise as part of the package to sell out Alberta for a Chinese pipeline to Asia. No binary choice for Albertans as you promised. Only political sleight of hand. You have lost the ability to refer to yourself as “Right Honourable” . You have lost the moral authority to lead the UCP. Please resign. Sincerely, Jeffrey R.W. 🚨 BREAKING NEWS - The recent Justice Shaina Leonard in Alberta saying that Government of Alberta must “consult” with First Nations prior to the Chief Electoral Officer approving a petition on Independence means that if it isn’t overturned on appeal Alberta will become ungovernable. The Chiefs are now saying that even a question to have a question on independence requires consultation. In effect you can’t consult with Albertans by way of petition or have an Election in Alberta without first “consulting” with the Chiefs of Alberta. The decision flows from mere assertion of “a treaty relationship”, a lack of “consultation” which according to Justice Leonard gives rise to “irreparable harm”. Governments make millions of decisions every year without “consultation” with First Nations. Every one of these decisions is now subject to injunctions.

Today, a judge has thrown out the Alberta separatist petition because Danielle Smith’s UCP government failed in its legal duty to consult First Nations. I want to thank the fearless First Nations who stood up and led this fight against separatism – not just for their nations, but for all Albertans and for Canadians. Specifically, thank you to the Athabasca Chipewyan First Nation, the Blackfoot Confederacy, and Sturgeon Lake Cree Nation, for fighting for our country with your time and money. First Nations are not alone, as the vast majority of Albertans stand alongside them, opposed to a costly, divisive exercise. This referendum violates treaty rights, it would cost Albertans hundreds of millions of dollars, and is now tied to serious public safety concerns thanks to the largest data breach in Alberta’s history. The Premier says that she’s exploring other ideas. Here’s an idea, Premier: call off the referendum and put this to bed. This petition is dead. This referendum is dead. For the premier to spend taxpayer time and money to resurrect it, would prove what we’ve always known: she’s a separatist. Accept the court’s decision. Nobody is above the law – and certainly not this Premier. Albertans are proud Canadians and want nothing more than to move on from this and focus on the things that really matter.

No, not for *any* referendum—only when Crown conduct (federal or provincial) might adversely affect established or asserted Aboriginal/treaty rights under s. 35 of the Constitution Act, 1982. This stems from the Honour of the Crown. Key Supreme Court cases: Haida Nation (2004), Mikisew Cree (2005). In the Alberta case, the judge ruled separation would impact Treaties 7/8, triggering the duty before petition approval. No consultation occurred, so the petition was quashed.
