Yes, it is possible. The principle is "facts are pleaded, not evidence." For example, if Mr. A pleads that Mr. B slapped him, and Mr. B denies it, the fact in issue has already been properly pleaded. Even if Mr. A did not list a CCTV recording in his pleadings, but later obtains the video, it can still be tendered in evidence. What matters is that the fact the evidence seeks to prove has already been pleaded. During trial, the lawyer will simply refer the witness to the relevant paragraph of the Statement on Oath: “In paragraph X of your Statement on Oath, you stated that the Defendant slapped you. How do you know this?” The witness may then respond that there is a video recording of the incident. The lawyer can proceed to lay the proper foundation to satisfy the requirements of Section 84 of the Evidence Act for electronic evidence and tender the recording. As long as the fact is pleaded, evidence supporting that fact can be tendered even if the specific document was not listed in the pleadings & FL documents.

The issue I have with the power of the AG is that the Constitution mandates that he must exercise that power in the "interest of the public," and “interest of justice” But what constitutes public interest and interest of justice remains largely within the AG's discretion. HMM🔥

When allegation of corruption is made against the judiciary, especially by a senior lawyer, I am always on the lookout for names. Who are the bribe givers? Who are the bribe receivers? It’s not a junior lawyer that will walk up to a judge to offer or give bribe. It is also not litigants that will walk into the chambers or the houses of judges to give them bribe. So when you want to make allegations, you have to bring forth specific facts as to the names of the judges or justices who took bribes from who and how much was paid. We cannot continue to rub the same paint on all our judges and justices. Some of them have sacrificed their lives to adjudicate over cases, even under the most unfavourable conditions. So if you won’t be mentioning specific names, keep your allegations to yourself.
