Ms. Sturko: I agree DRIPA should be repealed. However, while the court references DRIPA/UNDRIP in the Cowichan case, neither were determinative of the resulting ruling that Aboriginal title on unceded lands prevails over Crown granted fee simple titles. The court's property rights ruling was based on sec. 35 of the Constitution and the following landmark rulings from the Supreme Court of Canada as follows: - Calder (1973 – Aboriginal title exists at law, pre-sovereignty); - Guerin (1984 – title is a sui generis proprietary interest; Crown owes fiduciary duty); - Sparrow (1990 – Aboriginal rights constitutionally protected under s.35 of the Constitution); - Delgamuukw (1997 – title is a right to the land itself, exclusive and inalienable except to the Crown); - Haida Nation (2004 – duty to consult before title is proven); - Tsilhqot’in (2014 – Aboriginal title declared; unjustified provincial grants and fee simple interests cannot prevail). All of the above lead to the result in Cowichan. BC property rights are now in peril. Repealing DRIPA is a good idea but it won't fix property rights.
