We ask the khawarij who claim there is an ijma on this matter and those who label our ulema “murjiah” for their view, to be consistent and also label their sheikh with the same title. س/ السلام عليكم ورحمة الله وبركاته. شيخنا نود منكم تحرير مذهب الشيخ العلامة العلوان فهناك من يقول إنه لا يعذر بالجهل وهناك من يقول إنه يعذر وأنت من كبار تلاميذه فنريد منكم تفصيلا في ذلك بارك الله فيكم. وجزاكم الله خيرا. الجواب: وعليكم السلام ورحمة الله وبركاته هذه المسألة بارك الله فيك لا تحتمل إلا إما أنه يعذر أو أنه لا يعذر. أما أنه يعذر بقيد فهذا ممن يعذر ، فكل من عذر بقيد يعتبر فيه الجهل والتأويل فهذا يعذر ، ثم هذه القيود قيود اجتهادية تختلف من مكان إلى آخر باختلاف الأحوال والأزمان تبعا للأصل الذي بنى عليه العالم المذهب الذي اختاره في هذه المسألة. ولنعلم يقينا أن وجود هذا الأصل (العذر بالجهل والتأويل المعتبر في الأصول والفروع) ، هذا الأصل مقر عند الشيخ حفظه الله بكل جلاء ووضوح. فشيخنا فك الله أسره بالعز والتمكين يرى العذر بالجهل والتأويل المعتبر ويتصور وجوده في الأصول والفروع في أهل القبلة وهو يعتمد هذا الأصل في هذه المسألة. ثم بعد ذلك تأتي قيود وضوابط فهذا أمر آخر يختلف تماما عن من لا يعذر بالجهل والتأويل المعتبر. فالذي مذهبه عدم العذر لا يرى لهذا النوع من الأعذرا وجودا ولا أصلا ولا أثرا ولا شأنا. فهذا هو سر المسألة ، فمن فهم هذا علم مذهب شيخنا ومذهب غيره ممن يعذر بقيود ، وأنا كذلك ممن يعذر بقيود ، فأنا أقول بالعذر بالجهل والتأويل المعتبر ولي في ذلك قيود ولهذا فرقت بين المعتبر وغير المعتبر ، وقد فصلت هذا في كتابات وفي بحوث بثتها في قناتي وفي غيرها. فأعود وأقول: إن الذين يعذرون بالجهل والتأويل المعتبر يرونه ممكن الوقوع في الأصول والفروع. بمعني أنه يمكن أن يقع العبد من أهل القبلة في الشرك الأكبر لا عن إكراه ولا عن فقد عقل ولا عن خطأ بل يقع فيه جهلا أو تأويلا معتبرا. فالذين يرون العذر يقولون هذا متصور في الأصول والفروع ثم بعد ذلك تتباين قيودهم في ذلك. أما الذي لا يعذر فلا يرى أصلا للجهل ولا للتأويل المعتبر أثرا في المسألة مطلقا ، فطالما أن العبد وقع في الشرك أو في الكفر وهو ليس بمخطئ ولا مكره فهذا يكفر عنده مباشرة. أي لا عذر له مطلقا لا بالجهل ولا بالتأويل المعتبر في الأصول. من علم هذا القيد والضابط والتفريق الدقيق فهم المذهب لكل من الفريقين. فلا تأتي وتقول لي هناك شيخ يعذر بالجهل المعتبر لكن بقيود. فإنا سنقول مباشرة: إذا هو ممن يعذر ، فلا تدخله مطلقا ولا تقحمه في الفريق الذي لا يعذر. فإن الفريق الذي لا يعذر لا يرى الجهل والتأويل المعتبر عذرا ولا مانعا أصلا. فلابد من أن نفهم هذا الضابط المفصلي وإلا فسنقع في التخليط في أصل المسألة وسنخطئ على المشايخ في ذلك. والله أعلم.
