WHY AMUPITAN MUST RESIGN NOW. The recent revelation linking a pro-Bola Ahmed Tinubu tweet of 2023 to the Chairman of the Independent National Electoral Commission, Professor Amupitan, is not merely disturbing, it is a grave affront to the integrity of our electoral system. In a democracy, the umpire must be above suspicion. He must not only be independent, he must be seen, beyond any reasonable doubt, to be independent. That is the minimum standard required of anyone entrusted with the sacred duty of conducting free and fair elections. However, more troubling is the desperate attempt to tamper with digital records, to erase evidence of his previous partisanship. This is not a trivial matter. It is a calculated assault on truth and accountability. A man who manipulates records to save himself cannot be trusted to safeguard the mandate of millions. Over the past few days, it has been repeatedly revealed that Professor Amupitan, by his conduct, his utterances, and now by incontrovertible digital evidence, has fallen far below the standard expected of an electoral umpire. The referee cannot be running around in the shirt of one of the teams he’s supposed to officiate in a match. This is why Professor Amupitan must resign. Now. Anything less is an insult to the Nigerian people and a dangerous precedent for our democracy. Relying on this evidence, ADC will be updating our petitions to all relevant institutions, including to foreign governments and the Nigeria Bar Association, NBA. We will also renew and escalate our civil disobedience action until the INEC Chairman leaves office.

Yesterday, I honoured the invitation of the Goodluck Jonathan Foundation at the launch of its landmark report titled “Strengthening the Nexus Between Democracy and Economic Growth in Nigeria.” The report and the robust panel discussions that followed did not just present data; they reiterated the necessary truth that we have failed in critical areas of development: health, education, and pulling our people out of poverty. Over the past decade, our democratic progress has weakened while the economic well-being of our people has continued to decline. Consensus thinking from the event is that our leadership recruitment process must change for democracy to thrive. The recruitment must be based on competence, capacity, compassion, character, and commitment to serving the well-being of the people. And for it to thrive, our institutions must be strong, independent, and accountable to the people. We must rebuild trust in our institutions, restore discipline in Leadership, and ensure that governance translates into measurable improvements in the lives of Nigerians. INEC Chairman, Prof. Amupitan, is really feeling the heat. He was caught red-handed supporting Bola Tinubu and the APC. To show how confused and panicked he is, he changed his username and then rushed to open a brand new X account claiming it wasn't his. His actions only prove the allegations are true. Why change your username and open a new account? Does he think Nigerians are fools like Tinubu's supporters? I don't know who is advising him, but he looks lost and confused. Bro, just resign!

OUR LAWS AND DEMOCRACY MUST BE PROTECTED AT ALL TIMES The Nigerian Bar Association @NigBarAssoc has closely monitored recent political and legal developments as the nation gradually approaches the 2027 General Elections. These developments, particularly those arising from the interpretation and potential application of provisions of the Electoral Act 2026, raise serious constitutional, democratic, and rule-of-law concerns that require immediate intervention. We particularly deprecate the disturbing involvement by lawyers and courts in the internal affairs of political parties despite the clear provisions of the Electoral Act, 2026, which stipulates in Section 83 of the Act that “No court in Nigeria shall entertain jurisdiction over any suit or matter pertaining to the internal affairs of a political party.” Not only are courts denied jurisdiction to entertain any matter pertaining to the internal affairs of a political party, but they are also precluded from granting any interim or interlocutory injunction even where any action has been brought in violation of the Act. The section further provides that “Where such an action is brought in negation of this provision, no interim or interlocutory injunction shall be entertained by the Court, but the Court shall suspend its ruling and deliver it at the stage of final judgment and shall give accelerated hearing to the matter”. What we now see are situations where actions are not only instituted in Courts by lawyers in clear violation of the Act, but Courts purportedly grant interim and/or interlocutory injunctions in clear contempt of statutory provisions of the law. This does not augur well for our democracy. Democracy will not thrive in a situation where lawyers and courts take actions and decisions that not only negate our laws but also do violence to them. This emerging trend of subverting the clear letters of the Electoral Act and dragging courts into the internal affairs of political parties through disingenuous litigation, forum shopping, and malafide applications designed to secure undemocratic political advantage, bodes no good for our democracy. Such practices, if not immediately curbed, would directly contradict the clear intendment of the Electoral Act and risk transforming the judicial processes into avenues for political score-settling or electoral manipulation. We must reiterate that these provisions were clearly designed to curb abuse of court processes and discourage forum shopping in political disputes. This is therefore why the NBA is concerned that the abuse, misapplication, or selective deployment of these provisions may create opportunities for manipulation capable of undermining democratic competition and shrinking the political space. Members of the Bar are reminded that they are Ministers in the Temple of Justice and not political agents seeking judicial endorsement of partisan objectives. The filing of actions intended to draw courts into internal political party disputes, particularly where jurisdiction is expressly excluded, constitutes an abuse of court process and a violation of professional responsibility. The NBA will take firm steps to deter such conduct. Lawyers who deliberately file actions aimed at procuring judicial interference in intra-party affairs, or who seek ex parte or interlocutory orders in clear violation of statutory provisions, risk facing disciplinary proceedings. We will not hesitate to present petitions before the Legal Practitioners Disciplinary Committee (LPDC) against any Legal Practitioner found to be engaging in such conduct. This will be pursued decisively to serve as a deterrent and to preserve the sanctity of the judicial process. The Nigerian judiciary must stay vigilant and resist being drawn into political theatrics. Courts should firmly decline invitations, no matter how artfully crafted, to intervene in matters the law explicitly bars them from. A thread 1/2

U.S. Security Alarm on Nigeria: A Bad Omen The recent directive by the United States to evacuate its embassy staff from Nigeria due to rising insecurity is deeply worrisome and should be treated as a national emergency, especially for a country already struggling to attract investors. Nigeria currently ranks fourth in the Global Terrorism Index, yet insecurity continues to worsen - lives are being lost and communities remain under constant threat. There is a glaring absence of effective governance; instead, what prevails are schemes that undermine democratic processes, as though politics has taken precedence over the safety of citizens. The U.S. directive is a clear signal of declining confidence in our national security architecture. Disturbingly, reports indicate the loss of yet another Army Brigadier General to terrorists in Borno earlier today. A nation where people cannot live, work, worship, or travel safely cannot progress or attract investment. The primary duty of any government is the protection of lives and property, yet in this regard, we as leaders have fallen short over the years. Our failure continues to place immense strain on our troops, who make the ultimate sacrifices. Sadly, as Nigeria deteriorates, we as leaders, like Nero, remain preoccupied with politics, forgetting that without security, there is no nation to govern and no future to campaign for. We must resist the suffocation of our democracy by those who once claimed to have sacrificed to defend it, but are now doing everything possible to undermine it and silence opposition. History will not be kind to those who traded the struggle for democracy for the comfort of power.
