One hundred thirty-four academics and legal scholars released a joint statement expressing their disagreement with the dissolution of the Move Forward Party (MFP) and the removal of former Prime Minister Srettha Thavisin. They stated that the Constitutional Court has overstepped its jurisdiction by broadly interpreting legal provisions, resulting in the dissolution of the MFP and the disqualification of the Prime Minister. This approach conflicts with the principle that laws restricting individual rights should be interpreted narrowly and with great caution. Regarding the MFP case, the court’s expansion of the definition of actions undermining democracy to include party policies and legislative proposals is contrary to accepted democratic norms. In its decision to remove former Prime Minister Srettha, the court considered actions deemed dishonest and ethically questionable, extending to the nomination of individuals with potential qualification issues. The court also based its decision on public opinion rather than official constitutional evidence. Second, the proceedings in both cases did not adhere to due process principles. The court's discretion in setting procedures created uncertainty for the accused and the public. Evidence used in the cases, such as security agency reports, was accepted without giving the accused a fair opportunity to contest it, undermining the fairness of the rulings. Third, the court’s extension of its oversight into legislative and executive matters beyond its constitutional mandate undermines the separation of powers and threatens citizens' rights. This creates instability and interferes with the independence of the legislative and executive branches. Finally, these rulings damage public trust in Thailand’s legal and democratic systems. Dissolving a major political party and removing a Prime Minister based on questionable legal interpretations erodes confidence and fosters feelings of despair and distrust. The perception that legal decisions are driven by political motives rather than justice undermines the rule of law and democratic stability.
