I think one has to understand nuance and consequence to get the overall picture here. For the record, I'm just typing for people who are curious to make sense of this. When you submit a piece of copyrighted music whose copyright you don't own to a gen AI platform, that platform trains its models with the data you gave it. Say for example that their models end up creating a song which plagiarizes said copyrighted work. Then it means the company is liable for copyright infringement, and the copyright owners can easily take legal action. This has already happened a bunch by the way. By the ToS of those platforms however, whenever you submit materials to their servers, you agree to indemnify from any losses / damages caused by the way you used (or misused) their platform. And if the ToS clearly states you should only upload material you own the copyright for, and you decided to violate that by doing the opposite... Well, to put it bluntly, you may find yourself in trouble in case you're the initial instigator of said copyright violation with that upload I mentioned. Besides all that, from a moral point of view, the idea of using music that was created by someone else to train an AI model of a gen ai company without even asking them for permission, is absolutely disrespectful to them and is something that, as a musician myself, I find revolting. Again, it's all about nuance and consequence. Lots of people choose not to think about this stuff or act as if these matters don't exist or don't apply to them for whichever reason. I don't personally care too much about changing people's minds, but I think ai music cover consumers should at the very least understand what kind of person is behind said covers and how they're actually disrespecting artists they love, and playing with copyright law all the while.

@alex_moukala The ToS of anything at all has nothing to do with actual legality, as legality is determined by The United States Code and the code alone. Unless it is written into law, it is not illegal.

@KainYusanagi Again, check the ToS of the generative AI music platforms in regards to the legality of uploading audio materials onto their system.

@alex_moukala I can find nowhere any legal statement that supports what you have said. copyright.gov/ai/ addresses digital replicas and copyrightability of AI-generated works themselves, & copyright.gov/title17/title1… Title 17 itself does not either from what I see. Can you source specifics?

The moment you feed a copyrighted melody whose copyright you do not own, to a gen AI platform, in any shape or form, you’re breaking the ToS of said platform and violating copyright law. It doesn’t matter if you fed it 1:1 or if you re-created it and then fed it to the AI. It’s material you do not own, and as such, you have no right to give it to an AI company according even to their own ToS.

@alex_moukala Considering that the music is both its own thing (definitely not just ripped & used 1:1) and completely different style from the original (so not competing), and the vocals are definitely not replicating one of their voices, this comes across as free use, like any other cover.

Basically anything a person uploads to a generative AI music platform will be used by that platform for training its models. Which is absolutely fine if you’re uploading music that’s fully yours and you don’t mind about an AI platform absorbing your work and reusing it in a way that’s out of your control. But doing that with other people’s music is disrespectful to them, and also illegal

@KainYusanagi Oh man, would be 200% cooler if he wasn’t feeding music by other artists to a generative AI platform to make these remixes! People making “AI assisted” covers don’t know it’s technically illegal to do so. You should only upload music that you fully own to those gen AI services
