Can judges of appeal make mistakes ?
Judges of the Court of Appeal can make mistakes, despite the court's design to minimize errors in dispute resolution. There are instances when judges may err in matters of fact or law. If you believe that an appeal judge has made an error, the appropriate course of action is to request a review of the decision or file an appeal to the Supreme Court. However, it is important to note that the Supreme Court has limited jurisdiction and is not an open door for all cases.
The Supreme Court automatically has jurisdiction in disputes concerning the interpretation of the Constitution. For other cases, the dispute must involve a legal question of general public importance. To meet this threshold, you must apply for certification from either the Court of Appeal or the Supreme Court. If the Court of Appeal is the final court, any mistakes in its judgment cannot be reversed.
Interestingly, there exists a lesser-known procedure in common law that allows for challenging a final decision of the Court of Appeal through a reference before the full bench of the Court. In a notable instance, a full bench of the Court of Appeal of Tanzania overturned a decision made by a three-judge bench of the same court. As a young lawyer involved in the legal research for this case, I witnessed firsthand the complexities of the doctrines of 'finality of decision-making, justice, and jurisdiction.
I think we need to consider amending our rules to allow for exceptional circumstances where a full bench of the Court of Appeal can review decisions made by a panel of three or five judges in matters where the court holds final jurisdiction.

It's with a heavy heart that I come to say that the person who operated on that gentleman in Transnzoia is a medical doctor. I initially could not imagine that a trained medic could even do that,leave alone a medical doctor. After my investigations,I believe that either the gentleman is mentally sick or is just a cold blooded criminal. As such I demand that @KmpdcOfficial withdraws his license coz he is nolonger safe to practice medicine and @DCI_Kenya to take over the investigations and @ODPP_KE to prefer appropriate charges. As KMPDU we shall never defend our members when they endanger patient safety.
