Important to remind people that the ICC expressly rejected warrants for Israeli leaders for the lower threshold crime against humanity of extermination saying they were unconvinced that the elements were present. If you can’t get extermination, there’s no genocide.

J'ai eu l'honneur de la rédiger et de la signer aux côtés de mes confrères @ElliotMalin et Eli M. Rosenbaum, ancien Counselor for War Crimes Accountability au Département de la Justice américain. Notre client a perdu son épouse, ses enfants et plusieurs membres de sa famille pendant la guerre. Nous demandons l'ouverture d'une enquête à l'encontre de quatorze dirigeants du Hamas pour crimes de guerre et crimes contre l'humanité commis contre la population palestinienne elle-même. La communication documente l'utilisation systématique de civils palestiniens comme boucliers humains, en violation directe des Conventions de Genève de 1949, ainsi que l'enrôlement d'enfants, les exécutions sans procès, la torture, la persécution et l'extermination. À ce jour, le Bureau du Procureur n'a poursuivi aucun dirigeant du Hamas pour les crimes commis contre les Palestiniens. Cette asymétrie n'est pas tenable. I’m shocked that this is your takeaway after years of evidence of Hamas’ abuse and violations committed against Palestinians. Not that Khan, while in his capacity as Chief Prosecutor, didn’t work to bring justice for Palestinians when the perpetrators were Hamas.

We have filed, on behalf of our Palestinian client, a demand for warrants for the leadership of Hamas at the @IntlCrimCourt for the crimes committed by the terrorist government of Gaza against the Palestinian people. @KarimKhanQC and the Office of the Prosecutor cannot say that they truly care about justice if they continue to ignore the blatant crimes committed against the Palestinian people by Hamas. These crimes include numerous crimes against humanity and war crimes committed by Hamas against the Palestinian people. Notably including the war crime of utilizing the presence of civilians or other protected persons as human shields. There has never been a demonstration that the Palestinian's are willing and able to investigate Hamas for these crimes. Hamas' purposeful conduct in Gaza has greatly exacerbated the harm against Palestinian civilians. The unnecessary suffering of the Palestinian people must be accounted for and the ICC cannot claim to care about justice if it remains silent on these crimes. Thankful to the work of my colleagues, Eli Rosenbaum, and @sarah_scialom, and our brave client who came forward to tell their story.

@DanNeidle @__SylVan__ Look, I think the issue is your original thread intervened in a discourse with a specific effect (“he is not paying tax he should have paid and this is huge”). This is inevitable from your language in the thread. If you believed otherwise you should have disclosed it better
