Judges sincerely believe that when an attorney is scolded, or called out for misconduct in an appellate opinion, this changes their behavior. But I tend to think that, unless that scolding changes the result of the proceeding, the lesson is: keep going.

Anyone recommend some books on the literary invention of the reader, that is the idea that texts are fulfilled by a readership (or ‘people’) it simultaneously creates? The Bible and Dante’s Commedia are quintessential examples, I think.

What's a good noun for when someone considers two words synonymous? "That court treats X as meaning the same as Y. Other courts have adopted this ___ in their pattern jury instructions." "Synonymy" is the best I can think of.
