Perhaps more importantly long term, this judge held the bag search as legal/admissible. That’s real trouble for him if future judges concur.

Okay, so I know this is confusing to people, but the long story short version is that federal law does not so much concern itself with ‘plain old’ murder, and so prosecutors had to try to combine a few novel things here…which the court rejected (primarily on the basis that stalking is not necessarily violent). The reason this was even attempted is because the feds wanted the death penalty (which NY does not have). He’ll still be on trial for murder in NY.
