It blows my mind when commentators on Man City’s Premier League charges say that the alleged conduct was “highly unlikely”. I really just can’t tell whether they’re being disingenuous or biased to the point of delusion.
CAS unanimously found a years’-long conspiracy to commit the alleged conduct. All 3 arbitrators.
2/3 of the panel felt there was insufficient evidence to say certain individuals in the UAE then fulfilled the conspiracy. But what’s undeniable is that the intent was there from Man City’s exec team.
It also blows my mind that mainstream media outlets don’t bring this up when discussing the case either. The finding of fact was made - it’s not an allegation anymore. It’s a fact. Made by the court.
In para. 290 of the CAS decision, it is clear. “𝘛𝘩𝘦 𝘓𝘦𝘢𝘬𝘦𝘥 𝘌𝘮𝘢𝘪𝘭𝘴 𝘥𝘪𝘴𝘤𝘶𝘴𝘴 𝘢𝘯 𝘢𝘳𝘳𝘢𝘯𝘨𝘦𝘮𝘦𝘯𝘵 𝘸𝘩𝘦𝘳𝘦𝘣𝘺 𝘌𝘵𝘪𝘩𝘢𝘥’𝘴 𝘴𝘱𝘰𝘯𝘴𝘰𝘳𝘴𝘩𝘪𝘱 𝘤𝘰𝘯𝘵𝘳𝘪𝘣𝘶𝘵𝘪𝘰𝘯𝘴 𝘸𝘰𝘶𝘭𝘥 𝘣𝘦 𝘧𝘶𝘯𝘥𝘦𝘥, 𝘰𝘳 𝘱𝘳𝘰𝘤𝘶𝘳𝘦𝘥 𝘵𝘰 𝘣𝘦 𝘧𝘶𝘯𝘥𝘦𝘥, 𝘣𝘺 𝘏𝘏𝘚𝘔 𝘢𝘯𝘥/𝘰𝘳 𝘈𝘋𝘜𝘎.”
That’s based on the few emails CAS saw and it is referring to:
An email in September 2012 from Graham Wallace (COO) to Simon Pearce (Board Director), CCing Ferran Soriano (CEO);
An email in December 2012 from Andrew Widdowson (Head of Finance) to Simon Pearce, CCing Graham Wallace;
An email in December 2013 from Jorge Chumillas (CFO) to Simon Pearce; and
An email in August 2015 from Jorge Chumillas to Simon Pearce, CCing Ferran Soriano.
That means, CAS made a finding of fact that City’s Chief Operating Officer (COO), Chief Executive Office (CEO), Head of Finance and Chief Financial Officer (CFO), discussed arrangements over the course of 3 years, which sought to subvert FFP - the wrongful conduct the club is accused of.
And these commentators think it’s “highly unlikely” it happened?
In one of the emails, Andrew Widdowson (Head of Finance) clearly states that it did happen. I guess these commentators think it’s more likely that Widdowson (who is now the CFO of City Group’s New York City Football Club) was lying - for absolutely no possible reason - when he wrote that.
I’ve explained how Man City were able to escape justice at CAS - a mixture of Uefa gross incompetence and highly concerning CAS arbitration irregularities - but they stand absolutely no chance of evading justice at the Independent Commission.
Far, far, far more (crushing) evidence. Independent arbitrators. Lower standard of proof. It’s merely a waiting game now.
And if all commentators appropriately shared the full detail behind the CAS outcome, and did not ignore what was inconvenient to their narrative, then everyone else would know this too.
