Not releasing the game is a violation of multiple countries consumer protections acts that the game was being sold. They had a legal obligation to release it or refunds would be mandatory.

If i buy a car under the terms that "this is not the final version of the car and it will be updated until its final version" then i didnt buy the car as is. Tarkov wasnt sold "as is"
