The secret bilateral agreement between the U.S. and El Salvador—which facilitated the transfer of more than 250 migrants to CECOT—used a centuries-old statute, the Alien Enemies Act, to summarily remove individuals alleged to be members of the criminal gang, Tren de Aragua.

A clear example lies in the individuals who were deported from the United States and held at CECOT. These men were deemed “terrorists” despite having no active or ongoing criminal proceedings in the United States and had not been notified of any judicial action against them.
