@OrinKerr I read your first example as suggesting the addiction is based on the content of the tweets, which does raise first amendment issues. Meta doesn’t make the content you see on instagram, the instagram account holder does, and Meta wasn’t sued for the content.

@BarrientosTX So I could be held liable for negligence for my addictive feed, except I have a first amendment defense for what I arrange for my readers and meta doesn't have a first amendment defense for what it arranges for its readers? I guess I'm still confused as to where the line is.

I'm hoping that there are experts in tort law who will or have weighed in on this lawsuit, and I'd be interested to read their take. In particular, what's the line between an addictive website liable for user harms and non-addictive one that isn't?

Important to note that if a federal agent wants to kill you, that's basically between them and their conscience. You can't sue. The state can't prosecute. And these feds won't prosecute.
