I come at the PCSA as someone who works with college athletics departments. They desperately need stability. But watching this bill move toward a rushed vote feels like watching a train wreck in slow motion.
Congress may get only one real chance to rebuild the legal architecture of college sports. Instead, it is rushing a still-changing and deeply flawed bill because the August recess is approaching? This makes no sense whatsoever.
The bill imposes substantial new financial and operational obligations on athletics departments with radically different resources. It leaves major questions involving NIL, transfers, eligibility, roster limits, state-law preemption and enforcement unresolved.
It also gives private athletics organizations enormous federally protected authority to interpret the rules, investigate alleged violations and impose sanctions, without adequately addressing the private-nondelegation problem. Who is ultimately accountable? Who provides meaningful review? What process is due? Congress appears ready to immunize the system before answering those questions.
The people working inside athletics departments will be left to operate within the confusion, absorb the costs and hire lawyers to determine what the bill actually means. The bill’s most important additions are subject to obvious legal attack.
A no vote is not a vote against reform. It allows negotiations to continue through August so Congress can produce a coherent bill rather than accepting an exceptionally bad piece of legislation manufactured by an artificial deadline.
You get one chance to do this correctly. Right now, it feels like everyone can see the train wreck coming, yet no one is willing to pull the brake.
